Terms and Conditions
“Buyer” means the individual or organisation who buys or agrees to buy Goods from the Seller;
“Goods” means the services that the Buyer agrees to buy from the Seller;
“Contract” means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions
“Seller” means The Boutique Book Company Limited (www.boboco.co.uk) Registered office: Belfry House, Bell Lane, Hertford, Herts SG14 1BP
“Terms and Conditions” means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller.
Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a Consumer.
These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.
Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of these Terms and Conditions.
Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.
Order acceptance and payment
Orders are only accepted and processed in accordance with the following conditions. By making use of the Seller’s website the Buyer implicitly accepts these conditions.
All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to process an order. The Seller may choose not to accept an order for any reason.
Where the Goods ordered by the Buyer are not available the Buyer shall be notified and given the option to choose another product to the same value or wait until the Goods are available or cancel the order and receive a full refund within 30 days.
The Seller will take all reasonable care, within their power to do so, to keep the details of the Buyers order and payment secure. However, in the absence of negligence on our part the Seller cannot be held liable for any loss the Buyer may suffer if a third party procures un-authorised access to any data the Buyer provides when accessing or ordering from the Website.
The Price of the Goods shall be that stipulated on the Seller’s Website. The Price is inclusive of VAT and delivery charges to the UK mainland only. Additional charges for delivery outside the UK mainland will apply.
The total purchase price, including VAT and delivery charges, if any, will be displayed in the Buyer’s shopping cart prior to confirming the order. After the order is received the Seller shall confirm by email the details, description and price for the Goods. Payment of the Price plus VAT and delivery charges must be made in full before any image retouching, page layouts or any part of the production process has been started.
The buyer is responsible for the content of the files provided. The Seller accepts no liability for the content of the file. The Seller assumes that the customer holds the copyright for the files supplied in every instance. The Buyer is exclusively responsible for any consequences of the illegal use of protected data. In addition, the Buyer must strictly comply with the legal regulations of the concerned country when placing the order and in distribution of the printed material.
Limitations of Liability
The Seller will not accept any liability for damage or loss of the files. The Seller explicitly states that the quality of the images when printed in all our albums can never exceed that which can be expected from the files supplied. The Sellers liability remains limited to avoidable production errors.
Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the Price of the Goods and the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.
The Seller will provide the Buyer by e-mail to the specified address submitted in the order, a first draft album layout within 21 days of receipt of all images, layout requests and full payment.
Finished Goods that are to be supplied within the UK mainland will normally be delivered within 6 weeks from receipt of approval of the layouts provided by the Seller from the Buyer to email@example.com
All delivery dates are estimates and are not guaranteed. The Seller shall endeavour to use all reasonable means to meet estimated delivery dates, however, under no circumstances may any delays in delivery times justify cancellation of the order or any right to compensation by the buyer or any third party.
Delivery of the Goods shall be made to the Buyer’s address specified in the order and the Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.
Title and risk in the Goods shall pass to the Buyer upon delivery of the Goods.
Cancellations Refunds and Returns
Please note that you are entitled to cancel this contract if you so wish provided that you exercise your right no longer than 5 working days after the day on which you placed your order to receive a full refund.
Please note that your right to return goods only applies if they are faulty.
The Buyer shall inspect the Goods immediately upon receipt and shall notify the Seller sending an email to firstname.lastname@example.org within 24 hours of delivery if the Goods are damaged. If the Buyer fails to do so the Buyer shall be deemed to have accepted the Goods.
Where a claim of defect or damage is made the Goods shall be returned by the Buyer to the Seller. The Buyer shall be entitled to a full refund (including delivery costs) plus any return postal charges if the Goods are in fact defective.
Where returned Goods are found to be damaged due to the Buyer’s fault the Buyer will be liable for the cost of remedying such damage and the Seller shall not be held accountable.
The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations
